Southbound Tattoo Terms and Conditions

1. Ownership of Intellectual Property

1.1 Artwork and Designs

All artwork, designs, and photographs created or captured by Southbound Tattoo and its artists are exclusively owned by Southbound Tattoo and the respective tattoo artist. This includes but is not limited to:

• Custom tattoo designs.
• Photographs of completed tattoos.
• Preliminary sketches and drafts.

By engaging our services, you grant Southbound Tattoo and its artists a perpetual, royalty-free, worldwide license to use this intellectual property for:

• Advertising and promotional materials (digital and print).
• Social media posts.
• Portfolio displays, both online and offline.

1.2 Restrictions

Clients are prohibited from reproducing, distributing, or modifying artwork created by Southbound Tattoo or its artists without explicit written permission. Unauthorized use of artwork may result in legal action.

1.3 Exception for Minors

We respect the privacy of minors. Content related to piercings performed on individuals under 18 years of age will not be used for promotional or portfolio purposes unless explicit written consent is provided by a parent or legal guardian. However, if a minor is filmed or photographed during a public event hosted or attended by Southbound Tattoo, it may be used for promotional or social media purposes provided that no identifying personal information of the minor is disclosed.

2. Guarantees

At Southbound Tattoo, we stand by the quality of our services and products.

2.1 Tattoo Guarantee

We offer a 12-Month Tattoo Fix Guarantee to ensure your tattoo retains its bold and vibrant quality.

• If your tattoo heals faded, lines aren’t saturated and crisp, shading isn’t smooth or if anything isn’t up to your standards, within 12 months of application, we will restore it free of charge.
• This guarantee applies once per tattoo and excludes damage caused by improper aftercare, negligence, or external factors (e.g., excessive sun exposure).

2.2 Piercing and Jewelry Guarantee

We guarantee the quality of our piercing services and jewelry:

• 3-Day Guarantee: If jewelry falls out within 3 days:
• We will taper the piercing and replace the jewelry at no cost.
• If tapering is not possible, we will re-pierce the area for free after healing (typically within 4 weeks).
• 7-Day Guarantee: If a ball detaches from jewelry within 7 days, it will be replaced free of charge.
• 30-Day Guarantee: Defective jewelry will be replaced at no cost within 30 days of purchase.

2.3 Exclusions

Guarantees are void if:

• Aftercare instructions are not followed.
• Tattoo fading or jewelry damage results from negligence or external factors.
• The tattoo or piercing is altered by another artist or piercer.

3. Liability and Disclaimer

3.1 Health and Safety

Clients must disclose any relevant medical conditions, allergies, or sensitivities prior to the tattoo or piercing process. Southbound Tattoo is not liable for:

• Adverse reactions to ink, jewelry, or materials.
• Complications resulting from undisclosed health conditions.

3.2 Aftercare Compliance

Clients are provided with detailed aftercare instructions. Failure to follow these instructions releases Southbound Tattoo from any liability and voids applicable guarantees.

5. Tattoo Deposit Policy

5.1 Purpose of Deposits

Deposits secure your appointment and compensate the artist for time spent on design work. A deposit is required to:

• Confirm your booking.
• Begin work on custom designs.

5.2 Deposit Terms

• Deposits are non-refundable and non-transferable under all circumstances.
• The deposit will be applied toward the final cost of your tattoo upon completion.
• For multi-session tattoos, the deposit will be retained until the final session.

5.3 Deposit Forfeiture

Your deposit will be forfeited under the following conditions:

• Failure to attend a scheduled appointment (no-call/no-show).
• Cancellation within 24 hours of your appointment.
• Arriving more than 20 minutes late without prior notice.
• Canceling the same appointment three times, regardless of notice.
• Failing to reschedule within 30 days of cancellation.
• Rescheduling an appointment for more than 30 days after the original date.
• Canceling two consecutive appointments.

Southbound Tattoo reserves the right to update or modify these Terms and Conditions at any time. Updates will be effective upon posting to our website or notifying clients via email.

7. Governing Law

These Terms and Conditions are governed by the laws of Texas and The United States of America. Any disputes arising from these terms will be resolved exclusively in the courts of Texas.
